These Terms and Conditions govern access to and use of the Website Doctor website, platform, artificial intelligence tools, website analysis services, Shopify store generation services, downloadable files and related products and services.

The Website Doctor platform is available at websitedoctor.tech and is operated by [FULL LEGAL BUSINESS NAME], ABN [ABN], of [BUSINESS ADDRESS], referred to in these Terms as "Website Doctor", "we", "us" or "our".

By creating an account, purchasing access, submitting a website for analysis, generating content, downloading a file or otherwise using Website Doctor, you agree to these Terms.

If you do not accept these Terms, you must not use the platform.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use Website Doctor.

By using the platform on behalf of a company, partnership or other organisation, you confirm that:

you have authority to bind that organisation;
the organisation accepts these Terms; and
you are responsible for all activity conducted through the organisation's account.

You must provide accurate, current and complete account information.

2. Website Doctor Services

Website Doctor may provide:

AI-powered website and Shopify store analysis;
conversion-rate optimisation recommendations;
design, layout and content recommendations;
product pricing suggestions;
generated copy, code, images, configurations and other content;
AI-generated Shopify themes;
downloadable Shopify-compatible ZIP files;
website improvement reports;
store previews;
automated validation results;
AI assistants and chat functionality;
account dashboards and generation history; and
other related tools introduced from time to time.

Our services are designed to assist with website and ecommerce improvement. They do not replace professional legal, financial, tax, cybersecurity, accessibility, marketing or technical advice.

3. No Guaranteed Results

Website Doctor does not guarantee:

increased sales;
increased conversion rates;
increased traffic;
improved search-engine rankings;
customer acquisition;
profitability;
business growth;
compatibility with every Shopify app;
uninterrupted operation;
acceptance by Shopify or another third party;
that generated recommendations will be suitable for every business; or
that generated content will be error-free.

Any scores, forecasts, conversion estimates, pricing recommendations, performance projections or predicted results are estimates only.

Your actual results may be affected by factors outside our control, including product demand, pricing, advertising, competition, brand reputation, fulfilment, product quality, customer service, economic conditions, website traffic and changes made by third-party platforms.

You remain responsible for evaluating and testing all recommendations before using them.

4. Artificial Intelligence Limitations

Website Doctor uses automated systems and artificial intelligence. AI-generated outputs may occasionally:

contain errors;
misunderstand website content;
omit relevant information;
produce incomplete code;
recommend unsuitable changes;
rely on limited or outdated information;
create content similar to publicly available material; or
require human review and correction.

You must independently review all generated materials before publishing, installing, distributing or relying on them.

Website Doctor does not represent that AI-generated material is unique, exclusive, legally compliant or suitable for immediate publication without review.

5. Store Analysis

Website Doctor analyses only the information it can lawfully access or that you provide.

The analysis may be affected by:

blocked pages;
password protection;
robots.txt restrictions;
anti-bot systems;
inaccessible scripts;
geographic restrictions;
incomplete product data;
third-party applications;
unavailable pages; or
inaccurate information supplied by you.

An audit score or report represents an automated assessment at a particular time. It is not a certification, guarantee or complete assessment of your website.

Website Doctor may refuse to analyse any website where access would be unlawful, unauthorised, technically unsafe or inconsistent with these Terms.

6. Authority to Submit a Website

You may only submit a website, Shopify store, product listing, image, brand asset or other material where you:

own it;
operate it;
have permission from its owner; or
otherwise have lawful authority to submit and use it.

You must not submit a competitor's website for copying, impersonation, unauthorised extraction or reproduction.

You must not use Website Doctor to recreate, clone or imitate another business's theme, store, trade dress, branding or copyrighted content.

We may suspend generation if ownership or authority cannot be reasonably established.

7. User Content and Permissions

"User Content" includes any URL, product information, text, images, video, logo, trademark, theme, store data, review, document, instruction or other material you provide.

You retain ownership of your User Content.

You grant Website Doctor a limited, non-exclusive, worldwide licence to host, copy, process, analyse, transform and display User Content only as reasonably required to:

provide the requested services;
generate your analysis and files;
maintain platform functionality;
identify misuse;
provide support;
improve reliability and safety; and
comply with legal obligations.

You confirm that your User Content:

is accurate where accuracy is material;
does not infringe intellectual property rights;
does not breach privacy or confidentiality obligations;
is not unlawful, deceptive or defamatory;
does not contain malicious code; and
may lawfully be processed by Website Doctor.

You are responsible for securing any necessary permission from customers, photographers, designers, developers, employees and other third parties.

8. Generated Shopify Themes

Website Doctor may generate a Shopify theme ZIP based on your existing store, products, assets and analysis.

Generated themes may require:

manual installation;
replacement of placeholder content;
image optimisation;
Shopify theme-editor configuration;
product and collection assignment;
connection to Shopify applications;
testing;
accessibility review;
legal review; and
further development.

You must preview and test a generated theme before publishing it to a live store.

You must keep a backup of your existing Shopify theme and store data before installing or publishing generated files.

Website Doctor is not responsible for loss or damage caused by:

failure to create a backup;
installing files incorrectly;
publishing an untested theme;
editing generated code;
incompatible Shopify applications;
changes to Shopify;
third-party scripts;
custom code;
merchant configuration;
deleted data;
interrupted installations; or
use of the theme outside its intended environment.

9. Shopify Independence

Website Doctor is an independent service unless expressly stated otherwise.

Website Doctor is not Shopify, is not controlled by Shopify and does not guarantee endorsement, approval or support from Shopify.

"Shopify" and related trademarks belong to their respective owners.

You remain responsible for complying with:

Shopify's terms;
Shopify's acceptable-use rules;
app-provider terms;
payment-provider requirements; and
all laws applying to your store.

Shopify may change its systems, theme requirements, APIs or upload rules at any time. Such changes may affect generated themes or require updates.

10. Generated Content and Intellectual Property

Subject to payment of all applicable fees and compliance with these Terms, you may use the final generated output produced specifically for your account for your own lawful business purposes.

This permission does not transfer ownership of:

the Website Doctor platform;
our source code;
our underlying systems;
prompts and generation methods;
analysis frameworks;
software libraries;
reusable components;
proprietary templates;
algorithms;
trade secrets; or
materials owned by third parties.

Website Doctor retains all rights in its platform technology and reusable systems.

You must not:

reverse engineer Website Doctor;
extract or reproduce our underlying prompts;
copy our analysis process;
scrape the platform;
resell platform access;
remove proprietary notices;
bypass usage limits;
recreate a competing service using our protected technology; or
represent that you own Website Doctor's underlying platform.

Because AI systems may generate similar outputs for different users, we do not guarantee that an output will be exclusive to you.

11. Third-Party Material

Generated output may incorporate or interact with:

Shopify;
fonts;
libraries;
APIs;
stock assets;
applications;
plugins; or
open-source software.

Third-party materials may be governed by separate licences or terms.

You are responsible for reviewing and complying with third-party licence requirements before commercial use.

Website Doctor does not grant rights to trademarks, images, text, products or other material owned by third parties.

12. Pricing Recommendations

Any pricing suggestion generated by Website Doctor is informational only.

Pricing recommendations may be based on inputs such as:

product cost;
estimated demand;
competitor pricing;
target margin;
market positioning;
perceived value; and
information available at the time.

You remain solely responsible for:

deciding your final price;
verifying costs;
calculating tax;
complying with pricing laws;
avoiding misleading discounts;
maintaining profit margins; and
determining whether a product is commercially viable.

Website Doctor does not guarantee that customers will pay a suggested price or that the price will produce a profit.

13. Fees and Payment

All prices are shown in USD unless otherwise stated.

You agree to pay the price displayed at checkout, including any applicable taxes and transaction charges disclosed before payment.

Access will not be provided until payment has been successfully processed.

You authorise Website Doctor and its payment provider to charge the selected payment method for all amounts approved during checkout.

We may change our prices at any time. A price change will not alter a purchase already completed unless required by law.

Discounts, promotional offers and early-access prices may be subject to additional conditions and may be withdrawn at any time before purchase.

14. One-Time Purchases

A one-time payment provides only the access, usage allowance, features or deliverables described on the checkout page at the time of purchase.

A one-time purchase does not provide:

unlimited lifetime support;
unlimited future generations;
every future product feature;
permanent third-party hosting;
indefinite file storage;
ongoing custom development; or
guaranteed compatibility with future Shopify changes,

unless this is expressly included in the purchased plan.

Any "lifetime" access offer means access for the supported commercial life of that particular Website Doctor product, subject to these Terms. It does not mean the lifetime of the purchaser and does not require Website Doctor to operate indefinitely.

15. Subscriptions

Where a subscription is offered:

it will continue for the stated billing period until cancelled;
fees will be charged automatically using the selected payment method;
cancellation will stop future renewals but will not ordinarily reverse fees already charged;
access may continue until the end of the paid billing period;
unused usage allowances will not roll over unless expressly stated; and
deleting an account does not automatically cancel a subscription unless the cancellation process confirms this.

Renewal terms and prices will be displayed before purchase.

Nothing in this section limits rights that cannot legally be excluded.

16. Strict Refund Policy

16.1 Change-of-mind refunds

To the maximum extent permitted by law, Website Doctor does not provide refunds, credits or exchanges because:

you changed your mind;
you no longer require the service;
you purchased the wrong plan;
you failed to use the service;
you did not generate or download available files;
you did not cancel a subscription before renewal;
you expected a particular commercial result;
you disliked a subjective design choice;
your product did not sell;
your advertising campaign was unsuccessful;
you failed to follow instructions;
you failed to provide accurate information;
you failed to test generated content;
your Shopify applications were incompatible;
you lost account access through your own actions;
you purchased during a sale or promotion;
a third-party platform changed its requirements; or
you found another service after purchasing.

16.2 Commencement of digital services

You acknowledge that digital and AI services may begin immediately after payment.

Service commencement may include:

account activation;
allocating computing resources;
commencing analysis;
processing submitted content;
generating recommendations;
generating code;
creating previews;
creating reports; or
preparing downloadable files.

Once digital processing has begun, the service is treated as commenced for the purpose of our change-of-mind policy.

16.3 Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law or another applicable law.

Where the Australian Consumer Law entitles you to a remedy, Website Doctor will provide the remedy required by law.

A remedy will not ordinarily be available merely because you:

changed your mind;
selected the wrong service;
had unrealistic expectations;
did not review the service description;
failed to use the purchased access; or
experienced a problem caused by your own system or a third party.

16.4 Refund requests

Refund or remedy requests must be submitted to [SUPPORT EMAIL] with:

the account email address;
order number;
date of purchase;
clear description of the issue;
relevant screenshots;
details of troubleshooting already attempted; and
any other reasonably requested information.

Submitting a request does not automatically establish entitlement to a refund.

We may first investigate the issue and, where legally appropriate, offer correction, regeneration, repair, replacement access or another reasonable remedy.

17. Chargebacks and Payment Disputes

You agree to contact Website Doctor and provide a reasonable opportunity to investigate a payment issue before initiating a chargeback, except where doing so would be unreasonable or interfere with a legal right.

A chargeback must not be used to obtain a refund where you are not legally or contractually entitled to one.

Where a chargeback is fraudulent, abusive or submitted after the service was properly delivered, we may:

suspend the relevant account;
revoke access to generated files;
provide transaction and usage evidence to the payment provider;
recover unpaid amounts where legally permitted; and
refuse future service.

Nothing in this section prevents you from exercising a legitimate right through your bank, payment provider or applicable law.

18. Account Security

You are responsible for:

maintaining the confidentiality of your login details;
using a secure password;
restricting access to your account;
monitoring account activity; and
notifying us promptly of suspected unauthorised access.

You must not share, sell, transfer or publicly distribute your account credentials.

Activity conducted through your account may be treated as authorised unless you promptly notify us that the account has been compromised.

We are not responsible for loss caused by your failure to secure your account, except to the extent responsibility cannot legally be excluded.

19. Usage Limits

Plans may include limits on:

analyses;
store generations;
revisions;
AI messages;
storage;
downloads;
processing time;
websites;
users; or
file sizes.

Usage limits will be described on the applicable pricing or checkout page.

You must not create multiple accounts to avoid a limit or restriction.

Automated, excessive, abusive or unusually resource-intensive use may be restricted to protect the platform and other users.

20. Prohibited Use

You must not use Website Doctor to:

break any law;
infringe intellectual property;
impersonate another person or business;
create deceptive stores;
produce counterfeit products;
publish fake reviews;
generate false endorsements;
make unsupported medical, financial or product claims;
distribute malware;
inject malicious code;
conduct phishing;
steal customer information;
bypass platform security;
scrape protected data;
interfere with platform operation;
generate illegal, harmful or fraudulent material;
clone another store without permission;
manipulate customers through unlawful practices;
sell prohibited goods or services;
exploit children or vulnerable persons;
avoid sanctions, trade restrictions or regulatory requirements; or
use generated content in a manner that could cause unlawful harm.

We may investigate suspected misuse and cooperate with lawful regulatory or law-enforcement requests.

21. Reviews and Social Proof

Website Doctor may suggest locations, structures or placeholders for customer reviews and social proof.

You must not publish invented reviews, fabricated testimonials, false purchase counts, false urgency, fake media mentions or misleading endorsements.

You are responsible for verifying all customer claims and ensuring reviews comply with applicable laws and platform policies.

22. Legal and Compliance Responsibility

You are responsible for ensuring that your website or store complies with all applicable requirements, including those relating to:

consumer protection;
privacy;
cookies;
data collection;
email marketing;
accessibility;
intellectual property;
product safety;
advertising;
testimonials;
competitions;
tax;
shipping;
returns;
subscriptions;
age-restricted products; and
industry-specific regulation.

Website Doctor may generate example policies or compliance suggestions, but these are not legal advice and must be reviewed by a qualified professional.

23. Availability and Maintenance

We aim to provide a reliable service but do not guarantee continuous or uninterrupted availability.

Access may be affected by:

scheduled maintenance;
emergency maintenance;
security incidents;
internet outages;
cloud-provider issues;
third-party API failures;
unusually high demand;
AI-provider outages;
payment-provider outages;
Shopify changes; or
events outside our reasonable control.

We may update, modify, suspend or discontinue a feature where reasonably necessary.

Where practical, we will attempt to provide notice of a material permanent change.

24. File Availability

Generated files may only remain available for a limited period.

You must download and securely store completed files promptly.

Unless the purchased plan expressly states otherwise, Website Doctor does not guarantee permanent storage or indefinite access to generated files.

We are not responsible for a user's failure to download or back up files before their scheduled deletion.

25. Beta and Early-Access Features

Features labelled beta, preview, experimental or early access may:

be incomplete;
contain defects;
change without notice;
produce inconsistent results;
be unavailable at times; or
be discontinued.

You use beta and early-access features at your own discretion.

Claims such as "early access" do not guarantee exclusivity, permanent pricing or access to every future feature.

26. Suspension and Termination

We may suspend, restrict or terminate access where we reasonably believe that you have:

breached these Terms;
failed to pay an amount due;
misused the platform;
threatened platform security;
infringed another person's rights;
attempted to avoid usage limits;
submitted a fraudulent payment;
used the platform unlawfully; or
exposed Website Doctor or another person to material risk.

Where appropriate, we may provide an opportunity to correct a breach before permanent termination.

Immediate suspension may occur where necessary to protect users, systems, data or legal rights.

Termination does not automatically entitle you to a refund.

Any refund or remedy following termination will remain subject to applicable law.

27. Your Responsibility for Decisions

You remain solely responsible for decisions made using Website Doctor, including:

publishing a generated store;
selecting pricing;
changing product claims;
changing website copy;
collecting personal information;
installing code;
integrating applications;
spending money on advertising;
accepting customer orders;
processing payments; and
operating your business.

You must use reasonable judgement and obtain professional advice where necessary.

28. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

To the maximum extent permitted by law, Website Doctor is not liable for indirect, incidental, special or consequential loss, including:

loss of profit;
loss of revenue;
loss of opportunity;
loss of goodwill;
loss of anticipated savings;
loss of data;
interruption to business;
advertising expenditure;
Shopify downtime;
third-party account suspension; or
customer claims arising from content you publish.

Where liability can legally be limited, our aggregate liability arising from a particular purchase will be limited to the amount you paid Website Doctor for the service directly giving rise to the claim.

This limitation does not apply where liability cannot legally be limited.

29. Indemnity

To the maximum extent permitted by law, you agree to indemnify Website Doctor against third-party claims, losses and reasonable costs arising directly from:

your unlawful use of the platform;
User Content that infringes another person's rights;
your unauthorised submission of a website or store;
products or services sold through your store;
false or misleading claims published by you;
your breach of privacy or data-protection obligations;
malicious content introduced through your account; or
your material breach of these Terms.

This indemnity will be reduced to the extent that Website Doctor caused or contributed to the relevant loss.

30. Privacy

Our collection and handling of personal information is governed by our Privacy Policy.

By using Website Doctor, you acknowledge that data may be processed by service providers necessary to operate the platform, including hosting, payment, analytics, storage and AI providers.

You must not provide unnecessary sensitive personal information through website-analysis forms or AI chat.

31. Communications

You agree that we may send transactional communications relating to:

account verification;
purchases;
security;
generation progress;
downloads;
support;
service changes; and
legal notices.

Marketing communications will be managed in accordance with applicable law, and you may unsubscribe using the method provided.

32. Changes to These Terms

We may update these Terms to reflect:

service changes;
legal requirements;
security needs;
pricing structures;
new features; or
operational changes.

The updated version will be published with a revised effective date.

Where a change materially affects an ongoing paid service, we will take reasonable steps to notify affected users.

Continued use after the effective date constitutes acceptance of the updated Terms, except where further consent is required by law.

33. Severability

If any provision is found to be invalid, unlawful or unenforceable, that provision will be read down to the minimum extent necessary or removed.

The remaining provisions will continue to apply.

34. No Waiver

A failure or delay by Website Doctor to enforce a right does not waive that right.

A waiver is effective only if provided in writing by an authorised representative of Website Doctor.

35. Assignment

You may not transfer your account or rights under these Terms without our prior written approval.

We may transfer our rights and obligations as part of a genuine business sale, restructure or transfer, provided this does not remove any rights that cannot legally be excluded.

36. Entire Agreement

These Terms, the Privacy Policy, the Refund Policy and any plan-specific conditions presented at checkout form the agreement between you and Website Doctor concerning the service.

37. Governing Law
